Description

Book description:

  • Author's name: Dr. Ahmed Saleh Makhlouf

  • Number of pages: 240 pages

  • The subject of the book: Explanation of rights in rem

The contents of the book:

The first part of the book deals with the original in rem rights represented by the right of ownership and its subsidiary rights, namely the rights of use and utilization, habitation and easement, and monopoly, while the second part deals with the subsidiary in rem rights represented by the official (real estate) mortgage, the possessory mortgage and the rights of privilege.

The book relies on the latest Saudi regulations in presenting these topics, including: The system of ownership, sorting and management of real estate units issued by Royal Decree No. (M/85) dated 1441/7/2 AH and its executive regulations, the system of real estate registration issued by Royal Decree No. (M/6) dated 1423/2/11 AH and its executive regulations The Mortgage Law promulgated by Royal Decree No. M/(49) dated 13/8/1433 AH, the Law on Guaranteeing Rights to Movable Property promulgated by Royal Decree No. M/(94) dated 15/4/1441 AH and its Executive Regulations, and other relevant laws.

In addition, many of the book's topics have been compared to the provisions of the Islamic Shari'ah, with its abundance of rules and rulings on which the jurisprudence of transactions is based. The author believes that the law is not merely what the texts in the codices relate to, but rather it is those texts as they are interpreted and enforced within the walls of the courts and in the encyclopedias of the judiciary.
